Participation Agreement for Arte Brasil 2026 Project

CONTRACT FOR PARTICIPATION IN THE ARTE BRASIL 2026 PROJECT
CONTRACTANT: Designated in this contract through the data filled in the registration form.
CONTRACTOR: Arte Brasil Collective of Brazilian Artists, located in Aichi-ken Hekinan-shi Wakamatsu-cho 3-260, 202.
The parties above identified sign this Contract for Participation in the Arte Brasil 2026 Project, which will be governed by the following clauses:
ARTICLE 1 – OBJECTIVE
This contract has as its objective the participation of the CONTRACTANT in the Arte Brasil 2026 project, including exhibition, dissemination, and possibility of commercialization of their works as described below.
ARTICLE 2 – SERVICES OFFERED
The CONTRACTOR will make available to the CONTRACTANT:
Insertion of the artist's profile on the official Arte Brasil website;
Insertion of profile and up to 3 (three) works in the Arte Brasil 2026 Catalog;
Exhibition of works at the Arte Brasil 2026 event;
Possibility of sale on the Arte Brasil Digital Gallery, upon submission of the works in accordance with the curator's guidance;
Possibility of sale of products with the art of the CONTRACTANT on the LOJA.JP platform, provided that the artist formally authorizes this purpose and sends the files in accordance with the team's guidance.
ARTICLE 3 – OBLIGATIONS OF THE CONTRACTANT
The CONTRACTANT commits to:
Providing all necessary information, documents, and files in the established deadlines;
Declaring to be the author of the sent works, exempting the CONTRACTOR from any responsibility for the improper use of images of third parties;
Authorizing the use of their image and works for institutional dissemination purposes of the project, in digital, printed, or audiovisual media.
ARTICLE 4 – OBLIGATIONS OF THE CONTRACTOR
The CONTRACTOR commits to:
Inserting correctly the information and works in the described platforms;
Ensuring the visibility of the artist and their works in the channels and events linked to the project;
Using the artist's image and their works only within the context of promotion and dissemination of the Arte Brasil project.
ARTICLE 5 – REMUNERATION AND ROYALTIES
Participation in the project: The CONTRACTANT will pay the agreed value at the time of registration, which must be paid by 30 May 2026.
Use of the Arte Brasil brand: If the CONTRACTANT wishes to use the Arte Brasil brand in their own products for sale, they must request authorization and pay a royalty rate of 20% on the net sales value to the project.
Sale of products with the artist's work: If the CONTRACTANT authorizes the application of their work in products commercialized by the project (including the LOJA.JP platform), they will have the right to 15% of the net value of each sale, to be repaid by bank transfer or as credit in the store, as agreed.
ARTICLE 6 – CANCELLATION
The CONTRACTANT may request the cancellation of their participation by formal notice within 30 days in advance.
In any case of cancellation by the CONTRACTANT, there will be no refund of paid values, even if the contract is still in force.
ARTICLE 7 – SUSPENSION OF SERVICES
The non-compliance with the payment obligations until the established deadline may result in the suspension of the CONTRACTANT's participation in the activities and materials of the project, including the removal of already published contents.
ARTICLE 8 – FINAL PROVISIONS
This contract does not transfer ownership of the works, only grants the project the right to promotional and commercial use in accordance with the terms described;
In the event of a judicial dispute, the forum of the city of Nagoya, Japan, is elected for the resolution of any conflicts.
